PINEYWOODS LAW SMS/MMS TEXT MESSAGING – TERMS

These SMS/MMS Messaging Terms (the “Messaging Terms”) govern SMS/MMS text messages sent by or on behalf of PINEYWOODS LAW, PLLC (the “Firm,” “PWL,” “we,” “us,” or “our”).

1. DEFINITIONS

1.1. “SMS/MMS” means Short Message Service and Multimedia Messaging Service text messages.

1.2. “You” means the recipient of SMS/MMS messages from the Firm.

2. PROGRAM DESCRIPTION

2.1. Case-Related Messages. By signing our Contract and Power of Attorney Agreement or opting in by checking the box on the website when submitting your inquiry, you are agreeing to receive SMS/MMS messages regarding your inquiry or matter, which may include:

(a) appointment reminders;

(b) intake and case follow-ups; 

(c) requests for information (such as treatment status, photographs, copies of medical bills and records, health insurance related documents, identification information, etc.); and

(d) case status updates and related alerts.

2.2. Marketing/Promotional Messages. If you separately consent to receive marketing communications, the Firm may send occasional promotional messages (e.g., newsletters, service updates, offers, promotional materials, and other relevant information about the Firm). Consent to marketing communications is not required to obtain legal services.

3. OPT-IN METHODS

3.1. You may opt in to receive SMS/MMS messages through one or more methods, including:

(a) submitting a website form with an SMS/MMS consent checkbox; and/or

(b) providing your number during intake and consenting in writing (including within engagement/retainer materials or in a separate written SMS/MMS Messaging & Marketing Communications Consent).

4. MESSAGE FREQUENCY

4.1. Message frequency may vary.

5. COSTS

5.1. Message and data rates may apply based on your mobile carrier plan.

6. OPT-OUT AND HELP

6.1. STOP. To stop receiving messages, reply STOP at any time.

6.2. HELP. For help, reply HELP or contact the Firm at (903) 724-0055.

6.3. Confirmation. After you opt out, you may receive one additional message confirming your opt-out.

7. PRIVACY; MOBILE OPT-IN NON-SHARING

7.1. The Firm’s Privacy Policy is available at www.pineywoods.law/privacy.

7.2. Non-Sharing Statement. No mobile opt-in or text message consent will be shared with third parties or affiliates for marketing or promotional purposes.

8. CARRIERS AND DELIVERY

8.1. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier and phone/service availability.

9. NOT AN EMERGENCY SERVICE

9.1. Do not use SMS/MMS to send urgent or time-sensitive information. If you have an emergency, call 911.

10. NO LEGAL ADVICE BY TEXT; NO ATTORNEY-CLIENT RELATIONSHIP BY TEXT ALONE

10.1. SMS/MMS messaging is provided for convenience and may include general information.

10.2. SMS/MMS messaging alone does not create an attorney-client relationship. Legal representation begins only after a conflicts check and a signed engagement agreement.

11. CHANGES TO MESSAGING TERMS

11.1. The Firm may modify or terminate its messaging program or these Messaging Terms at any time without prior notice. Updated terms will be posted at www.pineywoods.law/terms with a revised “Last Updated” date.
